1. Preamble

These Terms of Use (hereinafter "ToU") govern the use of the JobAlign platform (hereinafter "the Service"), accessible at www.jobalign.app.

JobAlign is a service for automatically generating personalized resumes optimized for ATS (Applicant Tracking Systems), using artificial intelligence to adapt professional profiles to targeted job postings.

By using the Service, you unreservedly accept these ToU. If you do not accept these terms, you must immediately cease all use of the Service.

2. Definitions

• "User": Any natural or legal person using the JobAlign Service
• "Account": Personal space created by the User to access the Service
• "Resume": Document generated by the Service containing the User's professional information
• "ATS": Applicant Tracking System, application management software used by recruiters
• "LinkedIn Profile": Professional data synchronized from the User's LinkedIn account
• "Job Posting": Job description provided by the User to personalize their resume

3. Access and Registration

3.1 Access Conditions

The Service is accessible to any adult natural person with full legal capacity. Access to the Service requires an Internet connection and a compatible web browser.

3.2 Account Creation

Use of the Service requires creating an Account via LinkedIn OAuth 2.0 authentication. The User guarantees that:

• The information provided is accurate, complete and up to date
• They have the necessary rights to their LinkedIn profile
• They are the legitimate holder of the LinkedIn account used
• They will create only one Account per person

3.3 Account Security

The User is solely responsible for the confidentiality of their login credentials. Any use of the Service through their Account is presumed to be made by the User. In case of loss, theft or fraudulent use, the User must immediately inform us.

4. Service Description

4.1 Main Features

JobAlign allows the User to:

• Automatically synchronize their professional profile from LinkedIn
• Generate personalized resumes based on targeted job postings
• Optimize resumes for ATS systems
• Download generated resumes in PDF format
• Choose from several professional templates
• View the history of their generated resumes

4.2 AI Technology

The Service uses artificial intelligence models to:

• Analyze job postings and extract relevant keywords
• Select the most suitable professional experiences
• Rephrase content to optimize ATS passage rate
• Adapt the presentation according to the chosen template

4.3 Limitations

JobAlign is a resume creation assistance tool. We do not guarantee obtaining an interview or a job. Results depend on many factors external to the Service (profile quality, application relevance, market context, etc.).

5. User Obligations

5.1 Authorized Use

The User undertakes to use the Service in a fair manner and in accordance with its intended purpose. It is strictly prohibited to:

• Use the Service for illegal or fraudulent purposes
• Impersonate a third party or provide false information
• Resell, rent or transfer access to the Service
• Attempt to bypass security measures
• Extract, copy or reproduce the source code or algorithms
• Use unauthorized robots, scrapers or automated tools
• Overload or disrupt the Service's operation

5.2 Information Accuracy

The User guarantees the accuracy and truthfulness of the professional information provided. They are solely responsible for the content of their profile and generated resumes. JobAlign cannot be held responsible for any inaccuracy, omission or falsification.

5.3 Respect for Intellectual Property

The User guarantees that they have all necessary rights to the content they submit to the Service. They undertake not to include in their profile elements protected by third-party intellectual property rights without authorization.

6. Pricing and Payment

6.1 Pricing Model

The Service is offered on a "pay-per-use" model. Each resume generation results in a secure payment via Stripe. Current prices are displayed on the platform before each transaction.

6.2 Payment Methods

Payments are processed by our provider Stripe in accordance with PCI-DSS standards. JobAlign does not store complete banking data. Accepted payment methods include bank cards (Visa, Mastercard, American Express).

6.3 Invoicing

An invoice is automatically generated for each transaction and accessible from the User's Account. Prices are indicated in euros including VAT (applicable VAT included).

6.4 Price Changes

JobAlign reserves the right to modify its prices at any time. New prices will apply to future transactions. Users will be informed of any price changes by email or notification on the platform.

7. Intellectual Property

7.1 JobAlign Rights

The entire Service (source code, design, templates, algorithms, trademarks, logos) is protected by intellectual property rights and belongs exclusively to JobAlign. Any unauthorized reproduction, representation, modification or exploitation is strictly prohibited.

7.2 Usage License

JobAlign grants the User a personal, non-exclusive, non-transferable and revocable license to use the Service, limited to professional job search use.

7.3 Generated Content

Generated resumes belong to the User. By using the Service, the User grants JobAlign a worldwide, non-exclusive license to process, store and generate resumes. This license ends upon data deletion.

7.4 Feedback and Suggestions

Any feedback, suggestion or improvement idea communicated to JobAlign becomes our exclusive property and may be used freely without compensation.

8. Liability and Warranties

8.1 Service Availability

JobAlign strives to ensure continuous availability of the Service but cannot guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates or technical reasons beyond our control.

8.2 Quality of Generated Resumes

JobAlign implements all means to provide quality ATS-optimized resumes. However, we do not guarantee:

• A 100% ATS passage rate
• Obtaining interviews or jobs
• Compatibility with all existing ATS systems
• Complete absence of errors or inaccuracies in generated resumes

8.3 Limitation of Liability

Within the limits permitted by law, JobAlign cannot be held liable for:

• Indirect, incidental or consequential damages
• Loss of opportunities, data or revenue
• Content provided by the User or third parties
• Actions of third-party ATS systems
• Inappropriate use of the Service by the User

8.4 Force Majeure

JobAlign cannot be held liable in case of non-performance of its obligations due to a force majeure event (natural disaster, widespread Internet outage, government act, etc.).

9. Personal Data Protection

The processing of personal data is governed by our Privacy Policy, which is an integral part of these ToU.

By using the Service, the User consents to the processing of their personal data in accordance with GDPR and our Privacy Policy. Main guarantees include:

• Collection limited to strictly necessary data
• Data security through encryption
• No resale of personal data
• Right of access, rectification and deletion
• Limited retention over time

10. Duration and Termination

10.1 Duration

These ToU apply for the entire duration of the User's use of the Service.

10.2 Termination by User

The User may delete their Account at any time from their profile settings or by contacting us at support@jobalign.com. Deletion results in permanent erasure of personal data in accordance with our Privacy Policy.

10.3 Termination by JobAlign

JobAlign reserves the right to suspend or delete a User's Account in case of:

• Violation of these ToU
• Fraudulent or illegal use of the Service
• Abusive or harmful behavior
• Non-payment or unpaid amounts
• Prolonged inactivity (more than 2 years)

10.4 Effects of Termination

Termination immediately ends access to the Service. Generated resumes remain accessible for 30 days to allow their download. No refund will be made for payments already made.

11. Changes to ToU

JobAlign reserves the right to modify these ToU at any time to reflect Service developments, legal or regulatory changes, or for other operational reasons.

Users will be informed of any substantial changes by email or notification on the platform at least 30 days before they take effect.

Continued use of the Service after the changes take effect constitutes acceptance of the new ToU. In case of disagreement, the User must cease using the Service and delete their Account.

12. Applicable Law and Disputes

12.1 Applicable Law

These ToU are governed by French law. They are written in French. In case of translation, only the French version is authoritative.

12.2 Amicable Dispute Resolution

In case of a dispute relating to the interpretation or execution of these ToU, the parties undertake to seek an amicable solution before any legal action. The User can contact us at support@jobalign.com.

12.3 Mediation

In accordance with articles L.611-1 et seq. of the Consumer Code, the consumer User has the right to resort free of charge to a consumer mediator for the amicable resolution of the dispute. The contact details of the competent mediator will be provided upon request.

12.4 Jurisdiction

In the absence of an amicable resolution, any dispute relating to these ToU will be submitted to the competent courts according to common law rules.
